Every candidate for an election, including a candidate who withdrew his or her nomination, and every registered third-party advertiser, is required to file a campaign financial statement.
Financial Statements must be filed with the Town Clerk by 2 p.m. on March 31, 2023.
Candidates and third-party advertisers have to follow certain rules with spending and fundraising for their election campaign, including:
- Keeping detailed and accurate records of all financial information;
- Opening a dedicated bank account for all campaign activity;
- Staying within the prescribed spending limits for their office;
- Only accepting donations from people who are legally allowed to donate to them; and,
- Filing a complete and accurate campaign financial statement after the election with the Town Clerk.
Please note: Candidates are responsible for understanding and following the required legislation concerning the municipal election, including financial statements.
Filing Deadlines
Candidates and registered third party advertisers must file according to legislated deadlines.
For the 2022 Municipal Elections, an initial campaign financial statement is due by 2 p.m. on March 31, 2023. Candidates or registered third party advertisers who filed a Form 6 to extend their campaign must also file a supplementary campaign financial statement by 2 p.m. on Sept. 29, 2023.
Candidates and registered third party advertisers who identify an error in their submitted financial statement may withdraw their original statement and submit a new one by 2 p.m. on the filing deadline. Only corrected campaign financial statements will be posted to the website.
A candidate or registered third party advertiser who misses the filing deadline can submit their financial statement up to 30 days late, provided the $500 late filing fee required by the Municipal Elections Act is also paid.
If a candidate does not file a campaign financial statement by the end of the 30-day late period (and hasn't applied to the Ontario Superior Court of Justice for an extension), automatic penalties apply, including:
- Forfeiture of elected office (if applicable); and,
- Ineligibility to run for any municipal council or school board office in Ontario for a full election cycle.
Compliance Audits
An eligible elector who believes on reasonable grounds that a Council candidate or third party advertiser has contravened the Municipal Elections Act in respect to election campaign finances may submit an application for a compliance audit to the Town Clerk.
